In accordance with the FBiH Law on Real Rights, which has been in force since March 2014, foreign natural and legal persons are completely equal in terms of exercising rights and purchasing real estate with domestic persons.

Foreign persons acquire the right of ownership of real estate in the Federation of Bosnia and Herzegovina under the condition of reciprocity, except when the right is acquired by inheritance, unless otherwise determined by law or international agreement.

With the introduction of the notary service in 2007, laws in Bosnia and Herzegovina stipulated that only notaries can perform certain legal tasks, including sales contracts. This gave the notary service a monopoly over jobs that traditionally belonged to lawyers and municipal services.

However, there have been significant changes in the legal system. Now lawyers can also draft these contracts, subject to the fulfillment of certain formalities, such as notarization of the contractor's signature. The Federation of Bosnia and Herzegovina and its courts have recognized this possibility, and are obliged to accept and implement such contracts, including land registry offices.

When concluding a purchase agreement for real estate, it is important to prepare certain documents for the notary. Here's what sellers and buyers need:

Documents for sellers:

ZK extract: Extract from land registers.
Certificates of no debt: Proof that the property has no unpaid utilities (heating, water, garbage collection, manager, electricity).
Tax certificate: A certificate from the Tax Administration that the owner has no tax debt.
Proof of ownership: Previous sales contract, gift contract, inheritance decision, life support contract, etc.
Identification document: ID card, driver's license, passport.
Birth certificate: Birth certificate or marriage certificate.
Copy of the cadastral plan: If necessary.
Consent of the spouse: Or the presence of the spouse on the purchase contract (if the property was acquired during marriage).
Bank's consent: If the real estate is mortgaged, it is necessary to attach the bank's consent and a certificate of the remaining debt based on the loan agreement.
Power of attorney: If there are several owners and not all of them are present, a certified power of attorney is required for the person who is present. If the power of attorney is certified abroad, additional powers of attorney are required.
Consent of the usufructuary: If the right of usufruct for life is registered on the property.
Account number: Account number of the real estate owner or confirmation of an open account from the bank.
Other documentation: Which is required for the conclusion of the legal transaction.

Documents for customers:

Identification document: ID card, passport, driver's license.
Financial resources: Down payment or the entire amount of money (cash, credit or as agreed).
